Favorable Verdict Followed By Confidential Settlement
A
39-year-old woman suffered severe brain injury at a
Builders Square store when merchandise from an overhead
rack fell and struck her on the head. As a result of
the injury and the life-threatening complications which
later developed, this wife and mother of three became
an invalid. By the time of trial, her medical expenses
had mounted to several hundred thousand dollars.
David Perry and Joseph Barrientos represented the
woman and her family against Builders Square, Inc.
During the trial, evidence showed that the company's
practice of stacking merchandise on towering overhead
racks had resulted in other similar incidents in which
shoppers were injured by falling objects. A Nueces
County jury, after a two-and-one-half week trial, found
in favor of the plantiff. Builders Square appealed,
but our firm was successful in securing a confidential
settlement that has enabled the family to obtain the
costly medical attention that the victim will need
throughout her life.
